Terms & Conditions of Use

1. Introduction and Contracting Parties

These Terms and Conditions ("Terms") govern access to and use of the ISABEE mobile application and related services (the "Platform").

The Platform is operated by ISABEE INTERACTIVE LIMITED, a company duly incorporated under the laws of the Federal Republic of Nigeria ("ISABEE", "Company", "we", "our", or "us").

By creating an account, accessing, or participating in any tournament or activity on the Platform, you agree to be legally bound by these Terms, our Privacy Policy, and all related rules governing specific tournaments.

If you do not agree with these Terms, you must not use the Platform.

2. Definitions

• "Account" means a registered user profile on the Platform.
• "Tournament" means a structured trivia competition hosted on the Platform.
• "Entry Fee" means the amount paid by a participant to join a Tournament.
• "Prize Pool" means 80% of total Entry Fees collected for a Tournament.
• "Wallet" means the in-app balance used for participation and prize credits.
• "User" means any individual who registers and uses the Platform.

3. User Eligibility

• You must be at least 13 years old to create an Account.
• You must be at least 18 years old to join, register for, or play live Tournaments, including free and paid live Tournaments.
• By registering, you represent and warrant that all information provided is accurate and complete.
• The Company reserves the right to request proof of age at any time and may suspend or terminate Accounts found to be in breach.

4. Account Registration and Security

• Users must create an Account to participate.
• You are responsible for safeguarding your login credentials.
• The Company is not liable for unauthorised access resulting from your failure to secure your Account.
• Multiple Accounts per individual are prohibited.

5. Nature of the Platform

• ISABEE is a skill-based trivia tournament platform.
• Winners are determined strictly by: Knowledge (correct answers), Speed (response time), and Performance metrics.
• There are no lottery draws, chance-based outcomes, or random prize allocations affecting rankings.
• The only randomisation applied is the order of questions presented to each participant for fairness and anti-collusion purposes.
• Apple Inc. is not a sponsor of, responsible for, or involved in ISABEE Tournaments, prize pools, entries, payouts, or promotions.

6. How Tournaments Operate

Official Rules

• These Terms, together with the Tournament details shown in the app, are the official rules for each Tournament.
• Each Tournament displays or makes available its category, Entry Fee, player cap, start time, prize structure, gameplay rules, and ranking rules before participation.
• Void where prohibited by law. Users are responsible for complying with the laws and rules that apply in their location.

Registration

• A Tournament is created with a defined Entry Fee, category, player cap, and start time.
• Registration closes automatically 3 minutes after the Tournament start time.
• If the player cap is reached, registration closes immediately.
• Entry Fees are held securely until Tournament completion.

Gameplay

• Each Tournament contains 30 multiple-choice questions.
• Each question has 4 options and 1 correct answer.
• Participants have 25 seconds per question.
• Failure to answer within 25 seconds records the question as unanswered.
• No points are deducted for incorrect answers.
• Provisional results are displayed upon completion.
• Official results are finalised exactly 30 minutes from Tournament start time.

7. Scoring and Ranking

Each participant is ranked using a deterministic four-tier system:

• Score – Total number of correct answers (higher ranks higher)
• Pace – Total time taken (lower ranks higher)
• Max Streak – Longest consecutive correct answers
• Join Time – Earlier registration ranks higher (final tie-breaker)

All rankings are system-generated and reproducible.

8. Prize Structure

Platform Fee

The Company retains 20% of total Entry Fees collected for each Tournament as a platform service fee. The remaining 80% constitutes the Prize Pool to be distributed to eligible winners.

Formula: Prize Pool = Entry Fee × Number of Participants × 0.80

Prize Distribution

• (A) 2 Participants: 1st: 65%   2nd: 35%
• (B) 3–5 Participants: 1st: 50%   2nd: 30%   3rd: 20%
• (C) 6–10 Participants: 1st: 35%   2nd: 22%   3rd: 15%   4th: 14%   5th: 14%
• (D) 11–20 Participants: 1st: 50%   2nd: 30%   3rd: 20%
• (E) 21+ Participants: The top 10% of participants (rounded up) receive prizes. Distribution is determined using weighted rank percentages, all normalised to equal 100% of the Prize Pool.

9. Wallet, Payments and KYC

• Users must maintain sufficient Wallet balance to enter paid Tournaments.
• The Wallet is for tournament entry fees, prize credits, refunds, withdrawals, and promotional account credits. It cannot be used to purchase digital app features, Premium, or Extra Practice Packs.
• KYC verification is mandatory before any withdrawal.
• The Company may request: Government-issued identification, Selfie verification, Additional compliance documentation.
• Withdrawals may be delayed pending verification.
• The Company reserves the right to refuse withdrawals where fraud is suspected.

10. Refunds

• If a Tournament is cancelled before completion, all Entry Fees are fully refunded to participants' Wallets.
• Refunds are processed automatically and cannot be duplicated.

11. Practice Mode

• Practice Mode is free and does not involve cash prizes.
• Practice sessions award XP points and in-app progression only.
• Free users receive 5 practice sessions per 3-hour window.
• Premium users receive 15 practice sessions per 3-hour window.
• At the start of each new 3-hour window, available practice sessions reset to the standard allocation.
• Users may obtain additional practice sessions by purchasing them through the Platform or by watching an in-app advertisement (grants one additional session).
• Advertisement-granted practice sessions may expire at the end of the same 3-hour window and do not carry over.
• Purchased Extra Practice Pack sessions do not expire and remain available until used, subject to any maximum unused session balance shown in the app.

12. In-App Purchases and Subscriptions

• Isabee Premium is an auto-renewable monthly subscription at ₦5,000/month, billed through the App Store or Google Play.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period.
• You can cancel anytime in your App Store or Google Play account settings.
• Extra Practice Packs (3 sessions for ₦300) are one-time purchases. Purchased sessions do not expire and remain available until used.
• A Restore Purchases option is available in the app for eligible App Store and Google Play purchases.
• The Wallet cannot be used to purchase digital goods or app features. It is used for tournament entry fees, prize credits, refunds, withdrawals, and promotional account credits.

13. Prohibited Conduct

Users must not:

• Operate multiple accounts
• Collude with other players
• Share answers during live tournaments
• Use bots, automation, or scripts
• Exploit technical vulnerabilities
• Manipulate devices or IP addresses

14. Fraud, Collusion & Enforcement

• The Company may investigate suspicious activity.
• If fraud or collusion is detected, the Company may: Void results, Forfeit prizes, Reverse Wallet credits, Suspend or permanently ban Accounts.
• Decisions made under this clause are final, subject to dispute resolution provisions.

15. Intellectual Property

All content, trademarks, software, and systems remain the exclusive property of the Company. Users are granted a limited, revocable licence to use the Platform.

16. Data Protection

• The Company processes personal data in accordance with the Nigeria Data Protection Act 2023.
• Users consent to data collection necessary for: Account verification, Tournament administration, Fraud detection, Regulatory compliance.

17. Limitation of Liability

The Platform is provided "as is". To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential losses arising from use of the Platform.

18. Indemnity

Users agree to indemnify and hold the Company harmless from claims arising from misuse of the Platform or breach of these Terms.

19. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Federal Republic of Nigeria.
• Any dispute arising from these Terms shall first be resolved amicably.
• If unresolved, disputes shall be referred to Arbitration at the Abuja Multi-Door Courthouse, in accordance with applicable Nigerian arbitration laws. The decision of the arbitrator shall be final and binding.

20. Amendments

The Company may amend these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
